Terms of Service

Effective Date: January 1, 2026

These Terms of Service are provided in both Korean and English. In the event of any discrepancy in interpretation, the Korean text shall prevail.

Article 1 (Purpose)
These Terms of Service govern the rights, obligations, and responsibilities of YOLDCOMPANY ("Company") and users ("User") in connection with the use of Cosmify (cosmify.app) (collectively, "Service").

Article 2 (Definitions)
① "Service" refers to all features provided at Cosmify (cosmify.app), including the space creation editor, gallery, community, AI image generation, and goods shop integration.
② "User" refers to any person who agrees to these Terms and uses the Service.
③ "Paid Services" refers to features accessible after payment, including Pass purchases (Basic/Master), AI Credits, and 4K watermark-free downloads.
④ "Universe" refers to creative content created and saved by a User in the editor.
⑤ "AI Credits" refers to prepaid credits used to access the AI image generation feature.

Article 3 (Effectiveness and Modification)
① These Terms take effect upon being posted on the Service or notified to Users.
② The Company may modify these Terms for legitimate reasons within the bounds of applicable law, providing 7 days' prior notice within the Service.
③ Users who do not agree with modified Terms may discontinue use and withdraw from the Service.

Article 4 (Service Provision)
① The Company provides the following services:
  - Space creation editor (backgrounds, planets, ships, effects, and other elements)
  - Free and premium assets
  - AI image generation (powered by gpt-image-1, requires AI Credits)
  - Public gallery, likes, and contests
  - Goods shop integration (domestic Korea users only)
  - Image downloads (free: 1080p + watermark / paid: 4K watermark-free)
② The Service is provided 24 hours a day, 7 days a week in principle, but may be temporarily interrupted for system maintenance or unforeseen technical issues.
③ The Company will provide 30 days' notice before making material changes to the Service. In cases of unavoidable circumstances, notice may be provided immediately.

Article 5 (Paid Services and Payments)
① Prices for Paid Services are as displayed within the Service at the time of purchase.
② Payments are processed via Toss Payments (South Korea) or Stripe (global). The available payment method is determined by the User's region.
③ Pass purchases (Basic/Master) permanently unlock the corresponding assets immediately upon successful payment.
④ AI Credits are credited to the User's account immediately upon successful payment.
⑤ New users receive 1 AI Credit free of charge upon registration.
⑥ Due to the nature of digital content, refunds are generally not available after delivery. Please refer to the Refund Policy for full details.

Article 6 (User Content and Intellectual Property)
① Copyright in Universes created by Users belongs to the respective User.
② For Universes publicly shared in the gallery, the Company may display and promote them for service operation and marketing purposes, within the scope of the User's public sharing consent.
③ Copyright in Company-provided assets (backgrounds, planets, effects, etc.), UI, logos, and code belongs to the Company.
④ Users may use Company-provided assets solely for personal creative purposes within the Service. Unauthorized reproduction, redistribution, or commercial use is prohibited.
⑤ The ownership of copyright in AI-generated image outputs is subject to applicable law and the policies of the underlying AI provider.

Article 7 (User Obligations)
Users must not engage in any of the following:
① Impersonating others or registering false information
② Intentionally interfering with service operations or exploiting security vulnerabilities
③ Creating or sharing Universes that contain illegal, obscene, or hateful content
④ Infringing the intellectual property rights (copyright, trademark, etc.) of the Company or third parties
⑤ Causing excessive server load through automated tools (bots, scripts, crawlers, etc.)
⑥ Any other act that violates applicable laws or regulations

Article 8 (Service Restriction)
The Company may, without prior notice, restrict access to or terminate a User's account if the User is found to have violated Article 7.

Article 9 (Disclaimer)
① The Company is not liable for service interruptions or data loss caused by force majeure events, including natural disasters, wars, or cyberattacks beyond the Company's reasonable control.
② AI-generated images are creative outputs produced by an AI algorithm. Users are solely responsible for how they use, publish, or distribute such outputs.
③ The Company is not liable for disputes arising between Users and will not indemnify losses resulting from such disputes.
④ The Company is not liable for damages caused by a User's own fault or failure to follow posted instructions.

Article 10 (Governing Law and Dispute Resolution)
① These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
② Disputes shall be resolved through good-faith negotiation as a first step. If unresolved, the parties agree to the exclusive jurisdiction of the Seoul Central District Court, Republic of Korea.
